Description
1. Outline main issues of debate which surround the question of whether or not it is desirable to seek to protect fundamental rights in constitutional documents.
2. Assess the potential juristic significance of this exercise - positivization of natural rights. Theories of government can help not only to clarify matters of political debate but also to understand the character of the consequential shofts which are likely to be affected in legal discourse.
3. Assess whether the institutional protection of designated rights will put us on track for finding more effective, enlightened and responsive modes of governing.
UK Law - and EU law so far as it is appropriate to the subject.
The essay should be addresses as a whole but the three areas I have stated above should be clearly identifiable. I do not want an essay on human rights generally - an introduction is not necessary to the subject. You should get straight into answering the question. It's also NOT a philosophy essay although aspects of natural law will come in to it so there is an overlap but the main focus should be legal.
